Divorce filing can be a challenging experience, both emotionally and financially draining. In addition to all the issues involved in dividing your property, you may also need to worry about childcare, living arrangements, and the difficulties of starting over.

An Uncontested Divorce Is Easier And More Cost-Effective

There is a simpler, less-complicated, and cost-effective way to handle your divorce without an attorney. If you and your spouse are on friendly terms, or can at least negotiate how to divide your property and handle issues related to your children, then you can pursue an “uncontested divorce.”

Uncontested divorce agreements are the least expensive way to dissolve your marriage. This can enable you to more quickly get back on your feet and to put those funds towards your new life. Uncontested divorces are also more private, lowering your stress levels and helping both of you move on.

Prices may vary depending on your situation, but they will be a fraction of what you would spend on a divorce attorney.

In fact, most clients don’t have to go to court at all. We will complete all of the necessary steps in your case and, in most instances, cases are settled within the six months and one day waiting period.

We will fill out the following forms:

  • Petition for Dissolution of Marriage (or Legal Separation)
  • Response to Petition for Dissolution of Marriage
  • Income and Expense Declaration
  • Schedule of Assets and Debts
  • Marital Settlement or Agreement
  • Judgment on Dissolution of Marriage
  • Qualified Domestic Relations Order (QDRO) for division and disbursement of pension or benefit to a spouse following the dissolution of marriage.
Legal Separation

Legal separation: live apart, stay married

A legal separation allows a couple to live separately but remain married. During a period of legal separation, neither spouse may remarry or enter a domestic partnership. The procedure for legal separation in California is very similar to that of divorce.

Child Custody & Visitation

If you cannot come to an agreement regarding the custody and visitation of your children, you will be required to go through a court-ordered mediation. We can prepare the paperwork for that process.

If you are in agreement about custody and visitation we can prepare the paperwork to get a court order or modify an existing one.

Child Support

A change of orders, also known as a Notice of Motion, is a request submitted to the court asking for a modification to an existing court order — for example, changing child support, custody, visitation, or spousal support terms. You will need to provide the court with a declaration explaining how your circumstances have changed. In most cases, you do not need to hire an attorney for this.

About Muir & Associates

Susan Muir, owner of Muir & Associates, provides Legal Document Preparation in Family Law in Santa Rosa, CA. With over 25 years’ experience, her expertise is working with victims of domestic violence and their children. She has worked with law enforcement, probation, CPS and Judicial Law.

As the Senior Program Officer responsible for the overall operations of the Domestic Violence and Sexual Assault Services Program, she worked for the YWCA’s Women’s Domestic Violence Program. Susan also worked with the Santa Rosa Police Department in the Sex Crimes and Family Violence Unit.

Susan’s goal is to provide affordable solutions for your legal document preparation; offering less stress than the “do-it-yourself” path.

When Susan isn’t providing legal services to her clients she volunteers providing domestic violence education at the Buckelew Athena House / Hope Village Program, helping educate women about domestic violence and supporting them and their children.

When Susan is not working or volunteering she spends her time fitness training, at the beach with her dog LuLa, gardening, and relaxing with a good cup of tea.
